South Dakota: invasive & noxious plant laws
New laws coming: several states phase in plant bans 2027–2030. See dates and sources →
South Dakota's Weed and Pest Control law (SDCL ch. 38-22) makes landowners responsible for controlling the statewide noxious weeds the Weed and Pest Control Commission lists in ARSD 12:62:03:01.06; counties can add local weeds. It is a control duty; we did not find a state ban on selling these plants. Federal noxious weeds still apply.
